Terms of Service

These Terms of Service ("Terms") govern your use of the PlateAI mobile application ("the App"), operated by Sigentra ("we," "us," or "our"), a company registered in the United Kingdom.

By downloading, installing, or using PlateAI, you agree to be bound by these Terms. If you do not agree, you must stop using the App immediately.

1. Description of Service

PlateAI is an AI-powered nutritional tracking application that allows you to photograph meals and receive estimated nutritional information, including calories, macronutrients, and food item identification. The App also provides tools for setting daily nutritional goals and reviewing meal history.

2. Eligibility

You must be at least 13 years of age to use PlateAI. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you confirm that you have obtained consent from a parent or legal guardian.

3. Account Registration

  • You must create an account using Apple Sign-In or Google Sign-In to use the App.
  • You are responsible for maintaining the security of your account and for all activity that occurs under it.
  • You agree to provide accurate and truthful information.
  • We reserve the right to suspend or terminate any account that violates these Terms.

4. AI-Generated Nutritional Information — Disclaimer

THIS IS THE MOST IMPORTANT SECTION. PLEASE READ CAREFULLY.

  • PlateAI uses artificial intelligence to estimate nutritional content from photographs. These estimates are approximate and may be inaccurate, incomplete, or incorrect.
  • PlateAI is not a medical device, and the nutritional information provided is not medical, dietary, or health advice.
  • You should not rely on PlateAI as your sole source of nutritional information for managing medical conditions, including but not limited to diabetes, food allergies, eating disorders, kidney disease, or any other health condition.
  • Always consult a qualified healthcare professional or registered dietitian before making dietary decisions based on the App's output.
  • We make no warranties or guarantees regarding the accuracy, completeness, or reliability of any nutritional analysis provided by the App.
  • We are not liable for any health consequences, adverse reactions, allergic responses, or medical emergencies that arise from reliance on the App's nutritional estimates.

5. User Content

5.1 Your Responsibility

  • You are solely responsible for all images, text, and other content ("User Content") that you upload, submit, or transmit through the App.
  • You represent and warrant that you have the right to upload any content you submit and that such content does not violate any law or third-party rights.

5.2 Prohibited Content

You agree not to upload, submit, or transmit any content that:

  • Is illegal, harmful, threatening, abusive, defamatory, or obscene.
  • Contains nudity, violence, or sexually explicit material.
  • Infringes on any intellectual property rights, privacy rights, or other rights of any third party.
  • Contains malware, viruses, or any code designed to disrupt or damage the App or its infrastructure.
  • Is not a genuine photograph of food or a meal (e.g., uploading random images to abuse the AI service).
  • Depicts or promotes illegal drug use or other unlawful activities.

5.3 Our Rights Regarding User Content

  • We do not claim ownership of your User Content.
  • However, by uploading content to the App, you grant us a limited, non-exclusive, royalty-free licence to process, store, and transmit that content solely for the purpose of providing the PlateAI service to you (e.g., sending your image to our AI provider for analysis and storing it for your meal history).
  • We reserve the right to remove any User Content that violates these Terms, without prior notice.
  • We are not obligated to monitor User Content, but we may do so at our discretion.

5.4 Liability for User Content

  • We are not responsible or liable for any User Content uploaded by you or any other user.
  • You agree to indemnify and hold harmless Sigentra from any claims, damages, losses, or expenses (including legal fees) arising from your User Content or your violation of these Terms.

6. Credits and Payments

6.1 Credit System

  • PlateAI uses a credit-based system. Each AI-powered plate scan consumes one (1) credit.
  • New users receive five (5) free credits upon account creation.
  • Users receive a weekly refill of up to 5 free credits every Monday. If your balance is already 5 or more, no additional free credits are added.

6.2 Purchasing Credits

  • Additional credits may be purchased as consumable in-app purchases through the Apple App Store.
  • All purchases are processed by Apple and are subject to Apple's terms and conditions.

6.3 Refund Policy

  • All credit purchases are final and non-refundable, except where required by applicable law or Apple's refund policies.
  • Free credits have no monetary value and cannot be exchanged, transferred, or redeemed for cash.
  • Unused credits do not expire, but will be permanently deleted if you delete your account.

6.4 Failed Analyses

  • If a plate scan fails due to a technical error on our end (i.e., the analysis status is "failed"), we may, at our sole discretion, refund the credit used for that scan. We are not obligated to do so.

7. Acceptable Use

You agree to use PlateAI only for its intended purpose — personal nutritional tracking. You agree not to:

  • Reverse-engineer, decompile, or disassemble the App or its underlying technology.
  • Use the App to develop a competing product or service.
  • Attempt to gain unauthorised access to our servers, databases, or infrastructure.
  • Use automated scripts, bots, or scraping tools to interact with the App.
  • Abuse the credit system through fraudulent purchases, chargebacks, or exploitation of free credit refills.
  • Share your account credentials with others or operate multiple accounts.
  • Use the App in any manner that could damage, disable, or impair the service.

8. Intellectual Property

  • The PlateAI app, including its design, code, branding, logos, icons, and user interface, is the exclusive property of Sigentra and is protected by intellectual property laws.
  • "PlateAI" and the PlateAI logo are trademarks of Sigentra.
  • You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes, subject to these Terms.
  • This licence does not include the right to modify, distribute, or create derivative works based on the App.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • PlateAI is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory.
  • We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
  • In no event shall Sigentra, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, personal injury, or health consequences, arising from:
    • Your use of or inability to use the App.
    • Any errors, inaccuracies, or omissions in the AI-generated nutritional information.
    • Unauthorised access to or alteration of your data.
    • Any third-party conduct or content on the App.
  • Our total aggregate liability to you for any claims arising from or related to these Terms or the App shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim, or £50, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Sigentra, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the App.
  • Your User Content.
  • Your violation of these Terms.
  • Your violation of any applicable law or regulation.
  • Any claim that your User Content infringes the rights of a third party.

11. Account Termination

11.1 By You

  • You may delete your account at any time through the App's Settings. This will permanently delete all your data, including plates, images, and profile information.
  • Any unused purchased credits will be forfeited upon account deletion.

11.2 By Us

  • We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:
    • Violation of these Terms.
    • Fraudulent or abusive behaviour.
    • Extended inactivity.
  • Upon termination by us, you will lose access to your account and all associated data.

12. Service Availability

  • We do not guarantee that the App will be available at all times. The App may be subject to downtime for maintenance, updates, or unforeseen technical issues.
  • We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time, with or without notice.
  • We are not liable for any loss or inconvenience caused by the App's unavailability.

13. Changes to These Terms

  • We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this document.
  • Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
  • If you do not agree to the updated Terms, you must stop using the App and delete your account.

14. Governing Law and Disputes

  • These Terms are governed by and construed in accordance with the laws of England and Wales.
  • Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.
  • Nothing in these Terms affects your statutory rights as a consumer under applicable law.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sigentra regarding your use of PlateAI, and supersede any prior agreements or understandings.
